2022 Impact UpdateLast year marked 10 years of the Climate Science Legal Defense Fund, and as we move into a new decade of defending science, one thing is clear – more scientists than ever are in need of our services.

CSLDF Co-Releases Report on Implications of West Virginia v. EPA Decision
On October 6, we and several other groups released a report titled In the Wake of West Virginia v. EPA: Legislative and Administrative Paths Forward for Science-Driven Regulation, Safeguarding Government Regulation from Improper Judicial Interference.
In the West Virginia case, the conservative majority of the Supreme Court held that the U.S. Environmental Protection Agency does not have the authority to regulate greenhouse gases from existing power plants based on generation shifting mechanisms. As the report explains, this is an incredibly dangerous decision that ignores both legal precedent and the urgent need to address climate change. As Rachael Lyle, our Staff Attorney and co-author of the report states, “[t]his report offers specific, tangible recommendations for protecting our regulatory system and, frankly,our democracy from improper judicial interference. It’s a direct rebuke of the majority’s opinion in West Virginia v. EPA and an urgent call to action for anyone concerned with protecting evidence-based policymaking.”
